Terms of Use

NearSubs is a place to find local services and a console for running them. The service itself - the food, the milk, the laundry - is sold to you by the vendor, not by us, and you pay them directly.

1. Who we are

“NearSubs”, “we” and “us” mean the operator of nearsubs.com. “You” means whoever is using the platform, as a customer or as a vendor.

Using nearsubs.com or any part of it means you accept these terms. If you do not accept them, please do not use the platform.

2. What NearSubs is, and is not

NearSubs is a marketplace and a software service. Two things follow from that, and they shape everything else in this document:

  • Vendors sell their own services. The subscription you take is a contract between you and that vendor. They cook the food, set the price, decide the delivery days, and are responsible for what arrives. We are not a party to it, and we do not resell, prepare, handle, store or deliver anything.
  • We never take your money. There is no payment gateway on this platform. Customers pay vendors directly - usually by UPI, cash or bank transfer - and that money never passes through NearSubs, is never held by us, and we take no commission or cut of it. What our software keeps is a record of what a vendor says they were paid.

We are an intermediary within the meaning of the Information Technology Act 2000 and a marketplace e-commerce entity under the Consumer Protection (E-Commerce) Rules 2020.

3. Accounts

You must be at least 18 years old, or old enough to enter a contract where you live, and able to receive email at the address you sign in with.

Customers and vendors sign in with a six-digit code sent by email. There is no password. That code is the key to your account: do not forward it, and tell us at once if you think somebody else has used it. You are responsible for what happens under your account while you control the email address on it.

One account, one person or one business. Do not create accounts for anybody else.

4. If you are a customer

Subscribing. Choosing a plan sends a request to the vendor. It is not a confirmed subscription until they accept it, and they may decline. You choose your delivery area from the list that vendor serves; a request from outside those areas is refused before it reaches them.

Paying. You pay the vendor directly. NearSubs shows you what the vendor says is owed, and lets you attach a screenshot of your transfer so they can match it - that screenshot is evidence for them, it does not settle anything. Only the vendor can mark a bill paid, because only they can see the money arrive.

Pausing and cancelling. You can pause deliveries from your account, from tomorrow onwards - today's delivery is already made up and on its way, so it cannot be paused. Whether a pause reduces your bill depends on that vendor's policy, which is shown before you confirm. You can cancel at any time; anything you already owe for deliveries already made remains owed to the vendor.

What we ask of you. Give a real delivery address, be reachable, and pay what you owe. Do not use the platform to harass a vendor.

5. If you are a vendor

Your listing is your responsibility. Prices, delivery days, service areas, photographs, plan descriptions and your UPI details are entered by you and shown to customers as you entered them. They must be accurate and must describe a service you can actually provide. Your UPI details in particular are where your customers' money lands - nobody at NearSubs can set or change them for you.

You must be entitled to trade. You are responsible for your own licences, food safety obligations (including under the Food Safety and Standards Act 2006 where it applies to you), taxes and any other law that governs what you sell.

Your customers are yours. We do not contact them to sell them anything, and we do not pass them to another vendor. Equally, disputes about a delivery or a payment are between you and them.

What we charge. A flat monthly fee for the console - currently ₹999 a month, with your first month free. There is no commission and no per-order fee. Full terms, including what happens if you stop paying, are in the Refunds & Cancellation Policy.

Setting up on your behalf. Where you have asked us to, an operator may build your storefront for you before you sign in. Such an account stays closed to customers until it is explicitly activated, and we will never enter your UPI details for you.

6. Things nobody may do

  • List, request or arrange anything unlawful.
  • Impersonate another person or business, or misrepresent an association with one.
  • Upload anything you do not have the right to upload, or anything obscene or abusive.
  • Scrape, probe, overload or attempt to gain unauthorised access to any part of the platform, or to another account.
  • Use the platform to send unsolicited marketing to anybody you met through it.

7. Content you upload

You keep ownership of what you upload - your photographs, your descriptions, your screenshots. You grant us a non-exclusive, royalty-free licence to host, store and display it for the purpose of operating the platform, and for as long as you keep it there.

If you believe something on NearSubs infringes your rights, write to our Grievance Officer below with enough detail to identify it.

8. Availability

We try to keep NearSubs running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features. Where a change materially affects vendors who pay us, we will give reasonable notice.

9. Suspension and removal

We may suspend or remove an account that breaks these terms, that we reasonably believe is being used unlawfully, or - in the case of a vendor - that repeatedly fails the customers who rely on it. Where we suspend a vendor, their existing customers are not cut off mid-subscription without notice wherever we can avoid it.

You can close your own account at any time by writing to us.

10. Liability

Because the service is provided by the vendor and paid for directly to them, NearSubs is not liable for the quality, safety, legality, timeliness or non-delivery of anything a vendor supplies, nor for any payment made between a customer and a vendor.

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to any customer is limited to ₹1,000, and to any vendor is limited to the fees that vendor paid us in the three months before the claim arose.

We are not liable for indirect or consequential loss, or for loss of profit, goodwill or anticipated savings.

11. Disputes between customers and vendors

Raise it with the vendor first - the service was theirs and the money went to them, so they are the only ones who can put it right. We cannot refund what we never held.

If a vendor is repeatedly letting people down, tell us. We can suspend or remove them from NearSubs, which is the remedy we actually have.

12. Governing law

These terms are governed by the laws of India and subject to the jurisdiction of the Indian courts, without prejudice to any right a consumer has to bring proceedings where they live.

13. Changes to these terms

We may update these terms. The date at the top changes when we do, and we will email registered vendors about any change that materially affects them. Continuing to use NearSubs after a change means you accept it.

We acknowledge a complaint within 48 hours and aim to resolve it within 30 days of receipt.
